Wine Law - A Growing Industry

The popularity and growth of the wine industry in California has created some new and unique challenges. There is a myriad of Federal, State and Local laws regarding the cultivation of grapes and the production and sale of wine.  Many of those laws relate to the area of taxation and wine use.

Federal and State Laws

After the end of Prohibition, the Federal Government gave up much of its power in regard to the sale and production of alcoholic beverages within each state.  They have maintained a strict level of control in regards to interstate commerce, taxation of wine and other alcoholic beverages, and of labeling and truth in advertising.  As with all laws, those regarding wine continue to be complex and changing.  We are here to help the growers and wine producers, whether just starting up or a seasoned producer.

Business Succession

Most wineries are family run businesses.  The death of the head of the business can be devastating to the family and the business.  In many cases, a business can be destroyed by the death of the head of the business due to family squabbles, probate expenses, taxes, and a general failure of the family to know who is supposed to be doing what.  The only way to do so is through a detailed succession plan, which we will help you to design with the rest of the family.

Land Acquisition and Use

One thing that every winery has in common is that it needs the use of land.  Whether just an acre for building a winery, or hundreds of acres to maintain a vineyard, there are numerous land use obstacles that must be overcome.  Great care must also be exercised during the purchase of land, to make sure it is fit for its intended purpose.
