One of the most contested areas in Real Estate law stems from conflicts between Landlord and Tenants. It seems that the Landlord is always always worried about a unit being "trashed", or failing to make necessary repairs, of trying to evict a tenant for a variety of reasons. Tenants, on the other hand, feel that the landlord is acting unreasonably regarding restrictions, overcharging of security deposits and, in some cases, just feel that the landlord must be made of money because he owns property. Most disputes can be easily solved by referring to the California Civil Code as is applies to Landlord/Tenant relationships. There are also a number of communities that have enacted "rent control" ordinances that further affect the rights and liabilities of both the landlord and the tenant. Make sure that, if you are a landlord, that you have a good understanding of what a lease agreement says and what the Civil Code allows you to charge for. If you are a Tenant, make sure that you carefully read any lease agreement, and get some advice when you do not understand a portion of the lease. |
